ARTICLE 2 - SUBJECT AND SCOPE OF THE CONTRACT
This Distant Sales Contract ("Contract") has been prepared in accordance with the Law About Protecting The Consumer and the Regulations About Distant Contracts. Both parties agree that they know and understand their liabilities and responsibilities originating from the Law About Protecting the Consumer and the Regulations About Distant Contracts. The subject of this contract is to identify the rights and liabilities of both parties in terms of the Law About Protecting The Consumer and the Regulations About Distant Contracts in regard of the holiday residence that the lessor acting as the agent, renting the mentioned holiday residence via
www.azurahomes.co.uk or any other domain names ("Websites") that belong to Azura Homes Halis YANILMAZ ("Azura Homes Halis YANILMAZ") and about renting the stated holiday residence mentioned in the electronic agreement to be rented on the dates mentioned on the agreement and rental cost for these dates
Making of this contract does not interfere with the contracts separately made between the parties and Azura Homes Halis YANILMAZ about the membership on the website. Parties accept and declare that about sale of the product subject to this contract, Azura Homes Halis YANILMAZ is objective and is by no means responsible if parties neglect their liabilities.
ARTICLE 4 - THE BASIC SPECIFICATIONS AND THE PRICE OF THE PRODUCT SUBJECT TO THE CONTRACT.
The name of the holiday residence, reservation dates, total rental cost, deposit receive and amount to be paid at check in are as follows:

ARTICLE 4 - PRESENTING THE RESIDENCE
The contract is valid once the tenant confirms it and The Lessor presents the house to The Tenant The Holiday Residence will be presented to the Tenant himself/herself.
ARTICLE 5 - THE DECLARATION AND LIABILITIES OF THE TENANT
The Tenant declares that the holiday residence subject to the contract has the suitable reservation dates, The Tenant has confirmed the reservation cost and payment terms and also has read and has been informed about the Cancellation and Refund Policies that has been uploaded by the Lessor. The Tenants may forward their complaints as Consumers, via the contact details of The Lessor stated above.
By confirming electronically this Contract and the Cancellation and Refund Policies, The Tenant also confirms that he/she fully understood the basic information about the holiday residence, suitable dates and price for these dates and payment terms to be given by the Lessor before the distant contract is set up.
ARTICLE 6 - THE DECLARATION AND LIABILITIES OF THE LESSOR
The Lessor is liable to present the holiday residence in accordance with the Consumer Legislations with the reservation cost agreed upon. If the Lessor is not able to present the property to The Tenant on dates agreed upon because of force majeure, The Lessor has to inform the situation to The Tenant as soon as possible.
ARTICLE 7 - SOLUTION TO DISAGREEMENTS
If the consumers have any problem with The Lessor up to deposit value of ....... TL and could not solve it, they may take the subject to the Arbitration Committee for Consumer Problems located where they buy the service or where they reside. For issues that have values above .........TL, they may apply to the Consumer Court located where they buy the service or where they reside.
Entry 3, Article 5 of the Regulations for the Arbitration Committee for Consumers that has been published on Official Journal Number 25186 dated 01.08.2003, all providence arbitration boards acting in provinces classified as major cities have a certification to take care of issues with a monetary value of 3.032,65 TL.
ARTICLE 8 - RESERVATION PRICE OF THE HOLIDAY RESIDENCE
The price of the reservation for the holiday residence is stated on the reservation form, it is also present on the Customer Panel whose details are forwarded to you after the reservation is secured and on the contract forwarded to the customer as well. The discounts, coupons made by The Lessor or Azura Homes Halis YILMAZ are reflected to the sale price.
ARTICLE 9 - FAILURE TO PAY AND LEGAL EFFECTS
For the transactions done by the credit card, if The Tenant fails to pay the promised amount, the card holder will be paying interest in terms of the credit card contract that has been signed and will be liable to the bank. In such situations the bank may take legal actions and may ask The Tenant to pay the relevant fees and costs as well as Power of Attorney costs. The Tenant accepts to pay all the loss of the Lessor that may have occured once The Tenant fails to pay his/her debts on time.
ARTICLE 10 - ANOUNCEMENTS AND EVIDENCE CONTRACT
All the writings between the parties will be in e-mail except where it is obligatory by the Law to do otherwise. The Tenant accepts, declares and undertakes that in case of conflicts on this contract, the information that The Lessor and Azura Homes Halis YANILMAZ keeps in their own legal logs, trade registries, electronic data kept at the servers and computer logs are bonding and are certain evidence in terms of The article 193 of Law of Civil Court.
ARTICLE 11 - ENFORCEMENT
This contract made up of 11 (eleven) articles has been read by the parties and has been confirmed by The Tenant and is immediately effective.
